CASE / PERSONAL INSOLVENCY
Bank debts of Ms Kh. discharged through personal insolvency
The client could not service her loans; matters were complicated by the fact that she actually lives in Moscow but is registered in the Ulyanovsk Region. The case was conducted by Dmitry Malyutov, advocate of the Kovalev, Malyutov, Tsypkalo & Partners Moscow Bar Association.
- Headline figure
- RUB 1.9 million of bank debt
- Practice
- Personal insolvency
- Year
- 2020
The task
Ms Kh. approached the Kovalev, Malyutov, Tsypkalo & Partners Moscow Bar Association for help in resolving her position with the banks: she was unable to meet her obligations to repay the loans she had taken out. The difficulty was that she actually lives in Moscow while being registered in another region of Russia — the Ulyanovsk Region.
What we did
- Advocate D. Malyutov took the case on despite the gap between the client's place of residence and place of registration.
- Carried out a financial analysis and, on that basis, decided to apply to the court to have the client declared insolvent (bankrupt).
- Prepared the necessary set of documents for the application.
- Continues to provide legal assistance during the insolvency procedure itself.
The result
On 26 June 2020, in case No. А72-3325/2020, the Arbitrazh Court of the Ulyanovsk Region declared Ms Kh. insolvent (bankrupt) and opened a six-month procedure for the realisation of assets. Her debt to the banks stood at RUB 1.9 million.
