Frequently asked questions

I can no longer make my loan payments. Where do I start?

Keep talking to the bank: tell them about your difficulties, ask for restructuring or a payment holiday if you qualify, and assess all your debts together. If you have several loans, we compare the options: an arrangement with the banks, refinancing, bankruptcy.

Can my only home be taken?

As a general rule, the only home where the debtor lives with the family is not taken unless it is mortgaged. There are exceptions: for very expensive property, courts sometimes allow it to be replaced with more modest housing.

How much can bailiffs deduct from wages or a pension?

Under Federal Law No. 229-FZ of 2 October 2007 on Enforcement Proceedings, as a rule no more than half of the income. The debtor may ask for a monthly income at the subsistence minimum to be preserved. For child support and some other debts, deductions can be higher.

Who is entitled to a payment holiday?

It is a deferral of payments for up to six months on a consumer loan or mortgage. Federal Law No. 353-FZ of 21 December 2013 on Consumer Credit (Loans) grants it when income falls noticeably and in other hardship situations, provided the loan does not exceed the set limit.

When should I consider bankruptcy?

When the debt clearly cannot be repaid within a reasonable time and payments swallow all your income. There are court and out-of-court procedures (through the MFC), each with its own conditions and consequences. We compare them with other options before recommending anything.
