PRACTICE / 09
Two new statutes in a single summer — we work out which of them actually applies to your business.
In the summer of 2026 Russia's digital economy acquired a legal framework of its own. On 26 July the first Russian statute on artificial intelligence was signed — Federal Law No. 243-FZ on support for the development of AI technologies; on 4 August came Federal Law No. 282-FZ on digital currencies and digital rights. Both take effect in stages from 1 September 2026, and both are already surrounded by alarming retellings.
Our approach is simple: first we establish which rules concern you and which do not. The AI law, despite the headlines, is addressed above all to developers of large foundation models, not to every company with a chatbot. Law No. 282-FZ, by contrast, genuinely reshapes the market for everyone who deals in cryptocurrency: registers kept by the Bank of Russia, limits for investors, a ban on systematic peer-to-peer schemes. Where the fear is fashionable and where processes really do need rebuilding — we say so plainly at the first meeting.
Commercial disputes in Russia are heard by the arbitrazh courts — the state commercial courts, not private arbitration tribunals; disputes involving individuals go to the courts of general jurisdiction.
HOW THE WORK IS ORGANISED
We establish what is actually going on: which AI services you use and on what terms, which digital asset operations you run and through whom. We separate what is already in order from what needs rebuilding.
We match your processes against Laws No. 243-FZ, 282-FZ, 418-FZ and the related rules — with the dates on which each obligation takes effect. You receive a written plan: what to change now, what by the next stage, and what can be left alone.
Contracts, policies, internal rules, register entries, tax accounting — under the agreed plan and without stopping the business.
We track the secondary legislation the market is still waiting for under both statutes, update your documents as requirements land, and represent you in disputes — from correspondence with the bank through to court.
RESULTS
2regulatory regimes reconciled: energy and mining
A company installed a gas-piston power plant and mining hardware in leased premises. We ran a legal audit at the junction of electricity and mining regulation, restructured the project and the arrangements with the landlord, and took the client through to entry in the Federal Tax Service register of miners. The client's name is protected by a confidentiality agreement.

QUESTIONS
Yes. Cryptocurrency is recognised as property: it can be bought, sold, mined and inherited, and claims connected with it are protected in court provided it has been declared. The one thing that is prohibited is paying with it for goods and services inside Russia — a ban imposed both by Federal Law No. 259-FZ of 31 July 2020 and by the new Law No. 282-FZ of 4 August 2026. From 1 September 2026 Law No. 282-FZ builds a regulated market: transactions through participants entered in the Bank of Russia's registers, limits for non-qualified investors, cryptocurrency admitted as consideration in cross-border trade, and a ban on systematic card-to-card peer-to-peer purchases. The full transition to the new rules runs until 1 July 2027 — there is still time to prepare.
Yes, and since 2025 this has been regulated expressly: Federal Law No. 418-FZ of 29 November 2024 recognised digital currency as property for tax purposes and added Article 282.3 to the Tax Code. Individuals pay personal income tax on gains from sale and mining; companies on the general regime pay profits tax; such transactions carry no VAT, and most special tax regimes are closed to them. Miners additionally report the currency they receive — failure to file carries a fine under Article 129.16 of the Tax Code. How to calculate the base in your situation, and what to do about past periods, is a matter for the first consultation.
It goes into the insolvency estate as the debtor's property. The courts have applied this approach since case No. А40-124668/2017, in which the appellate court ordered the debtor to hand the insolvency practitioner access to his wallet, and the practice has only hardened since. A debtor should understand that concealing crypto assets risks being refused a discharge of debts, and that transfers of money into crypto on the eve of insolvency are open to challenge. For creditors we help trace such assets: bank statements showing transfers to exchanges, tax declaration data held by the Federal Tax Service, blockchain analytics. We run these matters together with the firm's insolvency practice.
Yes. Assets acquired during the marriage with common funds are the spouses' joint property regardless of whose name or wallet they sit in (Article 34 of the Family Code). The hard part of these disputes is proving that the wallet belongs to the spouse and that the asset still exists: bank statements, disclosure orders against exchanges and blockchain expert evidence all do the work. Interim relief filed together with the claim matters just as much — a crypto asset can be moved in minutes. We handle these cases jointly with the firm's family practice.
For the most part, no. Federal Law No. 243-FZ of 26 July 2026 is a support statute for the industry: it is addressed primarily to developers of large foundation models and imposes on ordinary users of AI neither prohibitions nor any mandatory labelling of content. That does not mean there are no rules at all. Sending client data to foreign AI services is a cross-border transfer under the personal data law, with notification to Roskomnadzor; generated content can infringe third-party copyright and image rights; recommendation algorithms on a website must be disclosed under Law No. 408-FZ. And if you operate in a regulated sector — banking, the financial markets — the choice of available models may in time narrow towards sovereign and national ones, which is worth building into your IT plans.
