What should we protect first?
Usually the trademark: the name and logo under which the product is sold. Then software, design, content and know-how: these do not always need registration, but the rights must be properly documented with developers and staff.
Who owns what employees and contractors create?
The exclusive right to works created by an employee in the course of their duties belongs, as a general rule, to the employer. With contractors it depends on the contract and the type of result, so it is better to state the transfer of rights expressly.
Can an idea be protected?
An idea as such is not protected. What is protected is its specific expression: a text, a design, software, an invention, and also know-how kept under a trade secret regime. So before talks with partners and investors it makes sense to sign a non-disclosure agreement.
How quickly can sales of counterfeits be stopped?
On marketplaces, a rights holder's complaint often gets listings removed quickly if the trademark is registered. If the infringer disputes it or sells offline, a claim letter and a lawsuit are needed, with interim measures if necessary.
We have received an infringement claim. What should we do?
Do not delete everything in a hurry and do not pay straight away. We check whether the claimant's right is valid, whether its registration covers your goods and services, and whether the compensation claimed is justified. Such disputes can often be closed by negotiation or the amount reduced.
