CASE / SUBSIDIARY LIABILITY
Subsidiary liability claim refused in the AO E. insolvency
The bankruptcy trustee applied to hold three of our clients subsidiarily liable. We obtained an order splitting the claims into separate proceedings and prepared an individual position for each. The Arbitrazh Court of the City of Moscow refused the trustee's application in respect of two of them; work for the third continues.

The task
Mr Z., Mr Z. and Ms D. approached the lawyers of Kovalev & Partners LLC after learning that, within the insolvency of AO E., the bankruptcy trustee had applied to hold them subsidiarily liable.
What we did
- Reviewed the insolvency file and analysed the trustee's case.
- Developed a defence strategy and prepared reasoned defences to the application — separately for each client.
- Obtained an order splitting the applications into separate proceedings, which accelerated the hearing.
- Continue to act for Ms D. in the proceedings to hold her subsidiarily liable.
