Nikulinsky District Court of Moscow: civil and administrative cases

How the court came to be

The court's history is shorter than the district's, but it shows well how the map of Moscow justice changed.

Until 1994 the south-west of Moscow was served by the Gagarinsky District People's Court. By Order of the Mayor of Moscow No. 30-RM of 25 January 1994 it was renamed the Nikulinsky Intermunicipal (District) People's Court of the Western Administrative Okrug. The name came from the municipal okrug of Nikulino, and the jurisdiction was drawn widely: the municipal okrugs of Matveevskoye, MGU, Nikulino, Ochakovo, Prospekt Vernadskogo, Ramenki and Troparyovo. The boundary ran from the junction of Leninsky Prospekt and the MKAD ring road along the MKAD to the Setun river, along the Setun to Minskaya Street, then along Mosfilmovskaya Street, Lomonosovsky and Michurinsky Prospekts to Vorobyovskaya Embankment, and back along Prospekt Vernadskogo and Kravchenko Street to Leninsky Prospekt.

In 2003 Moscow's intermunicipal courts were abolished. Federal Law No. 88-FZ of 2 July 2003 "On the Creation and Abolition of District Courts of the City of Moscow" transferred the administration of justice in the districts of Ochakovo-Matveevskoye, Prospekt Vernadskogo, Troparyovo-Nikulino and part of the Ramenki district to the Nikulinsky District Court of Moscow. The court has worked within these boundaries ever since.

The court was chaired by Tatyana Verzilina (1998–2011) and Pyotr Maltsev (2012–2018). Since December 2018 the chair has been Anton Tolstoy.

What the court hears

The Nikulinsky District Court is a court of first instance for civil, administrative and criminal cases within its territory. This page covers the civil and administrative side; the criminal side is described on the website of our bar association.

Residents and companies of the district meet the court in situations such as:

• real estate disputes: recognition of title, division of shares, claims against developers over deadlines and quality, challenges to transactions;
• housing disputes with management companies, eviction and move-in claims, disputes over use of a flat;
• inheritance cases: restoration of deadlines, unworthy heirs, division of an estate;
• family disputes involving children or property worth more than 50,000 roubles;
• debt and damage recovery above 50,000 roubles, road accident claims, larger consumer claims;
• administrative claims under the Code of Administrative Procedure of the Russian Federation: challenges to decisions of the district administration, the prefecture, bailiffs and the tax office outside business activity.

Claims under 50,000 roubles, court orders, alimony and divorce without a dispute over children go not here but to justices of the peace. Thirteen judicial precincts of justices of the peace operate under the court: Nos. 177–189 and No. 452. They have a separate page.

Decisions of the Nikulinsky District Court are appealed to the Moscow City Court.

How to check whether this is your court

The court's territory does not fully match district boundaries: Ramenki is assigned to the court only in part, and some streets belong to other district courts. Before filing, jurisdiction must be checked against the specific address of the defendant or the property. On the official portal of Moscow courts of general jurisdiction the Nikulinsky court has a "Territorial jurisdiction" service: it requires the house, building and block number and shows which court and which justice of the peace precinct the address belongs to. A jurisdiction mistake costs a month: the claim is returned while the limitation period keeps running.
