Goals
We meet one or both spouses and set down what the contract needs to settle.
FAMILY AND INHERITANCE / 05
A marriage contract makes sense when one spouse has a business, substantial pre-marital assets, a mortgage or debts. We draft it for your particular family so that both of you understand the terms and they can withstand a later challenge.
An entrepreneur is getting married and wants the company and its profits kept out of any division. Or the opposite: one spouse is giving up their career for the family and wants that contribution recognised. Either way, the contract settles questions that would otherwise be left to a court on divorce.
A couple is buying a flat with a mortgage: one pays the instalments, the other's parents provide the deposit. The contract lets them fix the shares in advance rather than arguing later about whose money went into the flat.
Sometimes a contract has already been signed, but it was made from a template: vague wording and clauses a court may treat as void. We review such documents and propose changes while the relationship still allows agreement.
HOW THE WORK IS BUILT
We meet one or both spouses and set down what the contract needs to settle.
We prepare the text with an explanation of each clause.
We discuss the draft with the other side, make changes and check it against the title documents.
We agree the text with the notary and attend the signing.
QUESTIONS
No, and this is a common misconception. Creditors who were not notified of the contract are entitled to disregard it, and a contract made to put assets beyond their reach can be challenged, including in bankruptcy. The contract allocates property between spouses; it does not hide it.
No. A marriage contract cannot govern rights and duties concerning children: that is decided by agreement between the parents or by a court. The contract can only set out how the spouses share family expenses, including the costs of the children.
It can be amended or terminated by agreement between the spouses, again before a notary. It cannot be done unilaterally, but a court may invalidate terms that place a spouse in an extremely unfavourable position. We assess such cases on the documents and the circumstances in which the contract was signed.

The consultation is free of charge when an engagement agreement is signed: on it we say what has to be done and by when.
