Tender review
We study the notice and the draft contract and assess the risks and the case for bidding.
PUBLIC PROCUREMENT / 01
Your company wants to work with state customers and state-owned companies, but bids keep being rejected, and awkward contract terms surface when it is too late to walk away. We check the tender before you bid and support you through to signing the contract.
A first tender: the company is registered in the unified information system but has no clear idea how to read the notice, the specification or the draft contract. The bid is put together from someone else's template and is rejected over a formal error.
An experienced bidder that used to win regularly runs into new rules: the national treatment regime, proof of country of origin, additional experience requirements. What worked a year ago now gets the bid rejected.
The contract has been won, and only now does the company notice the tight deadlines, a penalty for every breach and acceptance subject to expert review. Some of these risks could have been removed at the clarification stage.
HOW THE WORK IS BUILT
We study the notice and the draft contract and assess the risks and the case for bidding.
We prepare clarification requests and, where needed, a complaint about the notice.
We check the documents and wording of the bid before it goes to the platform.
We support contract signing and the early stages of performance.

QUESTIONS
The bid is signed with the bidder's own electronic signature. We prepare and check the documents, wording and calculations, and on an ongoing engagement we take on all the preparation, leaving the company to do the final check and sign.
Sometimes, if the risks are understood in advance and the company is prepared to accept them. But a Law 44-FZ contract hardly changes after the tender, so unacceptable terms are better challenged before bids close, through a clarification request or a complaint.
Under Law 223-FZ the customer sets its own rules in its procurement regulation: methods, deadlines, requirements and evaluation. There are no universal templates, so we read every tender together with that customer's regulation.
