Conversation with the family
Online, with an interpreter if needed: what is known about the death, who is in the family and what documents are at hand.
SERVICE MEMBERS AND FAMILIES / 01
If a foreign national died while serving under contract in the Russian Armed Forces, his family is entitled to payments under Russian law. It makes no difference which country the deceased came from or which citizenship his relatives hold. However, the money is paid only in Russia, in roubles and into an account with a Russian bank, and documents from abroad must be prepared to Russian requirements. We handle the matter for the family under a power of attorney: from collecting documents to a decision on each payment, and, if a claim is refused, in court.
The parents of the deceased live in his home country and learned of his death from his fellow servicemen. They have no death certificate, do not speak Russian and do not know where to turn.
A widow with two children lives abroad. The marriage was registered in her country, and the marriage certificate and the children's birth certificates are in the local language: English, French, Arabic, Spanish or any other. She has been told that the money is transferred only to a Russian account, and she does not know how to open one.
The widow lives in Russia, while the parents of the deceased stayed in the country of which he was a citizen. The recipients are in different countries, and each of them needs a separate set of documents and a separate power of attorney.
The family has received some of the payments, but the claim for the payment linked to participation in the special military operation was refused with reference to the circumstances of the death.
HOW THE WORK IS BUILT
Online, with an interpreter if needed: what is known about the death, who is in the family and what documents are at hand.
The text of the power of attorney, a list of documents for each relative, apostille and translation.
Requests to the military unit, the military commissariat and the civil registry offices.
Filing for each payment on behalf of each recipient and monitoring deadlines.
Inheritance case before a notary, challenging refusals in court.
QUESTIONS
Yes. The laws on these payments do not make citizenship a condition, either for the deceased or for the relatives. The limitations are practical: the money is transferred only in Russia, in roubles and into an account with a Russian bank, and documents from abroad are accepted with an apostille or legalisation and a translation.
Not for the right to the payments: the rules do not make the citizenship of the deceased or of the relatives a condition. The country affects how the documents are prepared: states party to the 1961 Hague Convention use an apostille, others need consular legalisation unless a treaty between Russia and that country dispenses with it. We establish the procedure for the specific country at the start of the work.
For the payments, a representative acting under a power of attorney is usually enough. The most convenient option is to execute it at a Russian consulate in the country of residence: it is drawn up in Russian straight away and needs no apostille. A trip may be needed, for example, if the family decides to apply for Russian citizenship: that application is filed with an MVD division in Russia.
The amount cannot be stated in advance. Each payment is divided equally among all recipients, the circle of recipients differs from one legal act to another, and the payment under Decree No. 98 is due only if the death is linked to participation in the special military operation. The monthly compensation, pension and regional payments depend on separate conditions. After talking to the family and checking the documents, we draw up a map of payments with the grounds for each.
No. The benefit, the insurance sum and the payment under Decree No. 98 belong to the family members by law, not to the deceased. So relatives who have renounced the inheritance still receive them, while an heir under a will who is not a family member does not. The inheritance is dealt with separately before a notary.
Official confirmation comes first: a death certificate or a death document in the prescribed form. If there is no information, the law allows a court to recognise the person as missing or declare him dead, and for participants in the special military operation the time limits are shorter (Federal Law No. 120-FZ of 14 April 2023).
